Youngblood’s former attorney to pay $5K for AI-related errors

Must read

Introduction to the Case

The attorney who formerly represented Duane Youngblood, whom Dallas’ Bishop T.D. Jakes is suing for defamation, will have to pay a $5,000 fine along with other sanctions, a judge ruled this week, citing errors in the lawyer’s court filings.

Jakes sued Youngblood for defamation after Youngblood alleged last year on a YouTube talk show that Jakes tried to sexually assault him. Tyrone Blackburn, who represented Youngblood, has now officially withdrawn from the ongoing case in a Pennsylvania district court.

Background of the Case

U.S. District Judge William Stickman IV previously said filings submitted by Blackburn in the case contained misrepresentations and fabrications of relevant case law. In his Monday ruling, Stickman said those errors went beyond an “innocent mistake.”

“At this point, any attorney — but especially attorneys like Blackburn with a cosmopolitan, multi-state, practice — cannot plead ignorance to justify their use or misuse of AI in drafting legal documents,” he wrote. Blackburn “doubled-down” after Jakes’ attorneys pointed out those errors, Stickman said.

Sanctions Against the Attorney

Stickman ordered Blackburn to pay $5,000 to Jakes’ attorneys, who had asked the court for over $76,000 to compensate them for the time they spent responding to Blackburn’s errors. Blackburn will lose the special permission he received for this case to practice law in Pennsylvania, where he is not licensed.

“[T]he Court believes that monetary sanctions are necessary to deter Blackburn from future misconduct — especially due to his decision to double-down on his misuse of AI after it was brought to the attention of the court,” Stickman wrote in his order.

Response from the Attorney

Blackburn said over email that he respected the judge’s order.
“AI is taking over the legal community, and I was not immune to the errors that may arise from this new trend,” he wrote. “This had nothing to do with the validity of TD Jakes’ claims, which I wholeheartedly believe are baseless.”
When reached for comment, Dustin Pusch, an attorney for Jakes, referred to prior filings in the case. In previous filings, Pusch pointed out other examples where Blackburn had appeared to be or had been accused of fabricating case law or using AI to generate inaccurate legal briefs.

The Allegations Against Bishop T.D. Jakes

Last year, Youngblood alleged during appearances on the YouTube talk show Larry Reid Live that Jakes groomed and tried to sexually assault him years ago. In November, Jakes sued Youngblood for defamation.
In January, Youngblood’s brother, Richard Youngblood, a Georgia minister, alleged in a sworn affidavit that Jakes also tried to sexually assault him. Jakes vehemently denied the allegations in a February affidavit.
Youngblood is a registered sex offender. He was convicted of sexual assault in 2008 and corruption of minors in 2014, according to the Pennsylvania sex offender registry.
Jakes founded and served as longtime senior pastor of Dallas megachurch The Potter’s House, which has 30,000 members, according to its website. In July, Jakes officially transferred leadership of the church to his daughter and son-in-law, Sarah Jakes Roberts and Touré Roberts.

Conclusion

The case against Duane Youngblood and the sanctions against his attorney, Tyrone Blackburn, highlight the importance of accuracy and integrity in legal proceedings. The use of AI in drafting legal documents can be a useful tool, but it is not a substitute for careful review and verification of facts. The consequences of misconduct, including monetary sanctions and loss of privileges, serve as a reminder to attorneys to uphold the highest standards of professionalism and ethics.
